Welcome to the AI Chatbot iOS App (the “App”) developed by ViralAI Limited (“we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
- Acceptance of Terms
1.1 By using the App, you affirm that you are at least 13 years old and are fully able and competent to enter into and comply with these Terms.
1.2 We reserve the right to modify these Terms at any time. Any changes to the Terms will be posted within the App. Your continued use of the App after the changes are posted constitutes your acceptance of the new Terms. - App Description and Limitations
2.1 The AI Chatbot App is an artificial intelligence-based conversational tool designed to provide users with an interactive chat experience. The App generates responses based on user input and does not have any inherent knowledge or understanding.
2.2 The App’s responses are generated using machine learning algorithms and may not always be accurate, complete, or up to date. The App should not be relied upon for any decision-making purposes, including but not limited to financial, legal, or medical decisions.
2.3 We do not guarantee the availability, accuracy, reliability, or suitability of the App for any particular purpose. The App is provided on an “as is” and “as available” basis. - Intellectual Property Rights
3.1 The App and all its content, features, and functionality are owned by ViralAI Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
3.2 You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of the App or its content. - User Conduct
4.1 You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not use the App:
a) In any way that violates any applicable federal, state, local, or international law or regulation.
b) To exploit, harm, or attempt to exploit or harm minors in any way.
c) To transmit or procure the sending of any advertising or promotional material without our prior written consent.
d) To impersonate or attempt to impersonate ViralAI Limited, our employees, or any other person or entity.
e) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which may harm ViralAI Limited or users of the App.
4.2 We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. - Disclaimer of Warranties
5.1 Your use of the App is at your sole risk. The App is provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
5.2 We make no warranty that the App will meet your requirements, that it will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the App will be accurate or reliable. - Limitation of Liability
6.1 In no event shall ViralAI Limited, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.
6.2 In no event shall ViralAI Limited’s total liability to you for all damages, losses, and causes of action exceed the amount of fifty dollars ($50.00). - Indemnification
7.1 You agree to defend, indemnify, and hold harmless ViralAI Limited, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App. - Governing Law and Jurisdiction
8.1 These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without giving effect to any principles of conflicts of law.
8.2 You agree that any action at law or in equity arising out of or relating to these Terms or the App shall be filed only in the state or federal courts located in Wales & England and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. - Severability
9.1 If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. - Entire Agreement
10.1 These Terms constitute the entire agreement between you and ViralAI Limited regarding the use of the App and supersede all prior and contemporaneous agreements, representations, and understandings between the parties regarding the App. - Contact Us
