Welcome to GhibliMe, a mobile application (“App”) owned and operated by ViralAI Limited (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the App.
By downloading, accessing, or using GhibliMe, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Use of the App
You may use the App solely for your personal, non-commercial use and in compliance with these Terms and applicable laws. You are solely responsible for any content you upload, generate, or share through the App.
2. User-Generated Content
You retain ownership of the images you upload; however, by uploading or submitting content (including photos) to the App, you grant us a non-exclusive, worldwide, royalty-free, and sublicensable license to use, process, store, and modify that content solely for the purpose of providing and improving the App and related services.
We do not claim ownership of any user-uploaded images or generated outputs, but we reserve the right to use anonymized, aggregated data for analytics and app improvement purposes.
You must not upload:
- Images of others without their consent
- Illegal, offensive, or harmful content
- Copyrighted or trademarked content that you do not own or have rights to use
3. Intellectual Property
All content within the App, including but not limited to artwork, logos, branding, user interface, and AI-generated styles, is owned by or licensed to us and protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or exploit any part of the App without our express written permission.
4. AI-Generated Content Disclaimer
The output generated by GhibliMe is for entertainment and artistic purposes only. While we strive to deliver high-quality content, we make no guarantees regarding the accuracy, appropriateness, or quality of any AI-generated image.
We are not liable for how you or others use the generated content, including any misuse, offense, or damage caused by sharing or publishing it.
5. No Warranty
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- The results generated will meet your expectations
- Any defects will be corrected
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR THE APP IN THE LAST 12 MONTHS.
7. Termination
We reserve the right to suspend or terminate your access to the App at any time, for any reason, including but not limited to violation of these Terms, misuse of the App, or if required by law.
8. Modifications
We may modify these Terms at any time. When we do, we will update the date at the top. Your continued use of the App after changes constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of London, UK, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in UK for the resolution of any disputes.
10. Indemnification
You agree to indemnify, defend, and hold harmless ViralAI Limited, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App, your content, or your violation of these Terms.
